To be (successfully)sued for either you need to prove quantifiable losses caused by the defendants actions. There would be no real way to quantify said "losses". I believe proving the losses is a standard part of tort law, which is pretty necessary because I could very easily say "shadow2797 told everybody I was a rapist", and then successfully sue you for it for an undefined sum if it weren't the case.

mainstream media paints a picture of video games being such a different medium for entertainment to be released on. I read this news story from the aggregation site fark.com. How many movies are released every year that depict horrific rape scenes or murders? If a video game were to offer a scene like that in the level of detail Hollywood shows, our community would be absolutely vilified for creating such a horror accessible to our children.

getting this game, however I have seen it played. The reason I am not purchasing this game is not due to ActiVision and Kotick being absolute sphincters, nor does it have to do with all of the decisions made for the PC version to be pretty much "gimped". That's where some of the logic could be flawed in some instances.
